Since the age of human awareness and the tempting of man with forbidden fruit, that which is prohibited always draws people in. As children, we received the list of forbidden places that we were not allowed to visit. Even some body parts, such as genitalia, were forbidden places for our touch or that of another.
Why does the forbidden attract us?  Perhaps it is the pure mystery of what is unknown.  From the desire of pubescent males to visit the forbidden places of sexual arousal, such as a strip club or topless bar to the young girls trying to peek inside the boy's locker room door, the places that were off-limits were attractions to be desired.  The "not knowing" creating a level of curiosity that many have trouble subduing.
Even as adults, forbidden places draw us in. How many politicians have seen the demise of their careers due to a night of lusty temptations at a brothel? Just look at the periodicals by the retail check-out stands and you'll find that pursuit of the prohibited is the major topic of most covers.

If nothing else, it certainly provides us with fodder for consternation. A greater mind than mine will be required to develop a methodology for making the forbidden less attractive to future generations.

Breast Cancer Genetic Testing Impacts Health Insurance

Prior to consenting to genetic testing for breast cancer chromosome mutations, one should understand the impact that such testing may or may not have on health insurance underwriting. With the dawn of this new technological ability and advances in identifying genetic mutations rapidly becoming available, the legal system hasn’t quite yet covered all the bases for protecting individuals from discriminatory practices based on results obtained from the procedures.
BRCA1 and BRCA2 genetic testing identifies alterations or mutations in the genes that identify a higher risk for breast and ovarian cancers. Most major health plans will cover the costs of this genetic testing for women who have a family history of breast cancer.  Typically, if a woman has a first-degree relative who has been diagnosed with breast cancer under the age of fifty, she will qualify in most major medical plans. When an individual covered under a group health insurance plan is treated differently from other participants due to these genetic testing results, this is a discriminatory practice. If you are contemplating a BRCA test, there are a few important facts you need to know.
If the tested individual receives a positive result for the BRCA alterations, they may incur difficulties with insurance underwriting.  It must be noted that if the person is covered under an employer’s group health insurance plan, they have some protection from this.  The Health Insurance Portability and Accountability Acct or 1996 (also known as HIPAA) prohibits group health plans from discrimination based on genetic test results if there is no disease present. A participant in such a group health plan may not be denied coverage based on a genetic test result. However, the Act does not restrict insurers from obtaining genetic test data.  Furthermore, an employer is not required to provide health insurance benefits to its employees. Most employers offer health insurance coverage as part of an employee’s compensation package to remain competitive in the talent acquisition market.
Currently, there are no specific US Federal anti-discrimination laws to protect individuals whose employers have knowledge of their positive BRCA1 and BRCA2 genetic test results.  It is worth noting that in 1995, the Equal Employment Opportunity Commission (EEOC) considers people who have a positive genetic test result that places them in a higher risk for contracting genetic diseases as “disabled”.  ADA, the Americans with Disabilities Act of 1990, offers some level of nondiscrimination protection from employers who make employment decisions based solely on the individual’s disability. As of this writing, there has not been a case before the courts, so there is no precedent set regarding genetic testing based discriminatory behavior.
Several states have laws regarding employers and group health insurance plans with regard to genetic testing.  These laws vary from state to state, so it is in the individual’s best interest to research the laws applicable to the state where they reside.  Several national non-profit agencies such as Komen for the Cure and the National Breast Cancer Foundation continually strive to raise awareness to this issue.   As there is currently no cure for breast cancer, early detection will provide the woman her best chances for survival.  BRCA genetic testing will assist in determining risk, and may make prophylactic surgery a woman’s best option.  The fear is that women who should be genetically tested will not do so out of fear of discriminatory treatment.  This could impede the woman’s options for any prophylactic treatment.
